Statement Regarding BoE Elections

The following is a statement regarding the Regional School District 14
Board of Education 2013 Election:

Fewer than the required three (3) candidates from each member town for seats on the Board of Education were nominated at the district meeting held on Thursday, May 9, 2013. As a result, the Board of Education will proceed as follows, based upon advice of counsel, the State Department of Education, and the Secretary of State’s office:

Conduct the election as scheduled on June 6, 2013 as governed by state statutes and the plan of      reapportionment. In the absence of a court order, the Board of Education does not have the authority to unilaterally circumvent this procedure or the timelines.
Allow additional petition candidates to appear on the June 6^th ballot provided two hundred (200) signatures are received by the town clerk of the petitioner’s town no later than the close of business on Thursday, May 16,      2013.
Allow additional candidates to appear as write-in candidates on the ballot, assuming that such write-in candidates comply with registration and any other applicable legal requirements.

Should a vacancy exist after the election on June 6, 2013, the standard procedure for conducting a public district meeting to nominate and elect a board of education member would be followed.

Clarification on Notice of Meeting

During the course of the annual District Budget Meeting on Monday, 5/6/13, a community member made a contention that the meeting had not been properly noticed, and that the district is obligated to notice such meetings in the same manner as town meetings and as dictated by town charter. This was taken under advisement by the Board of Education, though it was acting on the direction of counsel as well as past practice. The resident contended the Woodbury town clerk’s office had verified that the district had improperly noticed the meeting.

The district received a phone call this morning from the Woodbury town clerk’s office. After consulting with the State of Connecticut on the matter, she was able to verify that all the specific statutes governing the noticing of school district meetings were followed. Like all regional school districts in Connecticut, Region 14 does not follow the town charter from any member town for the budget meeting and referendum process, but rather applicable State laws, specifically the relevant portions of CGS Sections 7-3, 7-7, 10-47 and 10-51. Therefore, the meeting was properly and appropriately noticed five days before it occurred.
